Terms of Service

These terms govern use of the Local Kindness platform by customers, Territory Partners and workers (together, "users", "you"). By creating an account or using Local Kindness, you agree to these terms. Territory Partners are also bound by the commercial terms on the Local Kindness Licence page, which forms part of this agreement for Territory Partners; if the two conflict on a partner-specific matter, the Licence page governs.

The service

Local Kindness is a platform that lets Territory Partners operate a licensed local service business under the Local Kindness brand — with a territory site, service catalogue, booking, payment and job-allocation tools provided by the platform — and lets customers discover and book those services.

Accounts

You must provide accurate information when creating an account and keep it up to date. You're responsible for activity on your account and for keeping your login credentials secure.

Territory Partners

A Territory Partner claims and operates one territory under a paid licence (see the Licence page for pricing and commercial terms). Operating a territory does not make you an employee, agent, or legal representative of Local Kindness — you operate your territory as an independent business under licence, subject to these terms and the platform's standards.

Customers

When you book a service through a territory site, you're entering into an arrangement for that service to be delivered by the relevant Territory Partner and their worker(s). Payment is collected securely through Stripe at the time of booking. Nothing in these terms limits your rights under the Australian Consumer Law, including consumer guarantees that can't be excluded.

Intellectual property and data ownership

What a Territory Partner brings to the platform remains theirs. Genuinely pre-existing intellectual property or materials a Territory Partner brings to Local Kindness — for example, their own logo, original photos they took, or business content created independently of the platform — remains their property. By adding that material to your territory site, you grant Local Kindness the licence reasonably needed to host, display and operate it as part of the Local Kindness service, for as long as your territory is active (and, for material that also documents platform activity — e.g. a job completion photo — for as long as needed to keep an accurate platform record).

What the Local Kindness platform generates remains with Local Kindness. Local Kindness retains and controls the platform business assets generated through the platform, including:

  • Customer relationships, contact records, and platform accounts;
  • Emails, messages and other platform communications;
  • Enquiries, bookings, orders and transaction histories;
  • Reviews and territory history and performance information;
  • Marketing information and analytics;
  • Territory addresses (e.g. doubleview6018.localkindness.com.au) and the goodwill built through the platform;
  • Provider and worker relationships developed through the platform.

A Territory Partner is given the access needed to operate their territory, and may use customer information to provide and market Local Kindness services within their territory while their licence is active. A Territory Partner must not take, sell, scrape, export, or otherwise use Local Kindness customer or platform data for any business or purpose unrelated to operating their Local Kindness territory, and must not retain or continue to use that data after their licence ends. This is in addition to, not instead of, the personal-information handling requirements in our Privacy Policy — customer personal information is never treated as unrestricted property, by Local Kindness or by a Territory Partner, and must always be handled consistently with applicable privacy and direct-marketing law.

Local Kindness owns the platform itself — its software, design, brand, service catalogue and the Local Kindness name and marks. Nothing in these terms transfers that ownership to any user.

Payments

Territory licence fees and customer bookings are processed through Stripe. Territory Partners set their own local pricing for services within the platform's catalogue and keep the earnings from each job, less the relevant worker's share, as described on the Licence page.

Acceptable use

You agree not to:

  • Use the platform for any unlawful purpose, or in a way that breaches another person's rights;
  • Misrepresent your identity, business, or affiliation with Local Kindness;
  • Interfere with the platform's security or normal operation;
  • Use platform data in a way inconsistent with the Intellectual property and data ownership section above.

Suspension and termination

We may suspend or terminate an account that breaches these terms. A Territory Partner's access to their territory is also governed by the licence terms on the Licence page (for example, a lapsed licence payment pauses a territory). When a Territory Partner's licence ends, their operational access to the territory and its platform data ends with it; Local Kindness retains the platform business assets described above, consistently with our Privacy Policy.

Disclaimers and liability

The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Local Kindness excludes all warranties not expressly stated in these terms, and limits its liability for any claim relating to the platform to the amount you paid Local Kindness in the 12 months before the claim arose. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

Changes to these terms

We may update these terms as Local Kindness grows. We'll post the updated version here with a new "last updated" date. Continued use of the platform after an update means you accept the revised terms.

Governing law

These terms are governed by the laws of Western Australia, Australia.
